These Terms of Use apply to your use of this website. Your use of this website signifies your acceptance of these Terms.

1. Liability

1.1 Leith Pub Co excludes all liability for damage, injury or loss arising directly or indirectly from any defect in or non-compliance of the product. In any event, Leith Pub Co Ltds liability whether in contract or otherwise, for any loss damage or injury arising directly or indirectly from any defect in or non-compliance of the product or any other breach of Leith Pub Co Ltds obligations under these terms and conditions shall not exceed the price of the products ordered by the customer.
1.2 Leith Pub Co Ltd shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall Leith Pub Co Ltd be liable for any damage or loss caused by the customers servants agents buyers or other persons.
1.3 Notwithstanding this, none of the exclusions and limitations in the clause are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded.

2.Intellectual Property

2.1 We are the owner or the licensee of the copyright in this website, its contents and images and no part of this website may be reproduced without our express permission or the permission of the copyright holder.

3. Children

3.1 We do not sell products to or offer services for children.
3.2 We have restrictions on use of login to purchase special products/alcohol. The customer shall ensure that no persons shall use his/her login to purchase alcohol if that person is not legally permitted.

4.Product Availability

4.1 Every effort will be made to fulfil orders placed with Leith Pub Co Ltd but Leith Pub Co Ltd shall not be liable to any party if Leith Pub Co Ltd decline to supply the Products for any reason whatsoever.
4.2 Leith Pub Co Ltd does not allow back orders for specials that are not available at the point of ordering.

5.Product Range

5.1 Leith Pub Co Ltd reserves the right to limit the range of products available to the certain areas.
5.2 Leith Pub Co Ltd reserves the right to limit quantities that can be ordered by a customer.
5.3 Leith Pub Co Ltd may delay dispatch of bulk orders due to stock availability. Delivery may be by instalments.

6.Seasonal lines

6.1 Every effort will be made to fulfil orders placed with Leith Pub Co Ltd but Leith Pub Co Ltd shall not be liable to any person if Leith Pub Co Ltd are unable to supply products due to the seasonal nature of said products.

7.Payment

7.1 The Customer shall make payment of each order by credit card at the time of placing an order. Leith Pub Co Ltd accepts Visa and Mastercard. You will be charged in New Zealand dollars.
7.2 Leith Pub Co Ltd reserves the right to disable a customer’s account for any reason whatsoever.
7.3 The Customer is liable for all costs associated with debt collection where the Customers payment has defaulted for an order(s).
7.4 Leith Pub Co Ltd may change at any time the way in which the Customer pays for the products and change the will be notified to the Customer via Leith Pub Co Ltd.

8.Delivery

Leith Pub Co Ltd delivers to most locations within North and South Islands of New Zealand.
8.1 Proof of ID. The customers warrants that they will show current identification to the person(s) delivering the goods for Leith Pub Co Ltd. This identification may include but not be limited to customers full name, date of birth and photo. Leith Pub Co will not deliver to any customer who is under the age of 18 and/or cannot show identification proving they are 18 years or older.
8.2 Right to withhold delivery. Leith Pub Co Ltd may withhold the right to deliver products to the customer for any reason whatsoever (including, without limitation or location)
8.3 Reasonable Endeavour’s. Leith Pub Co Ltd will use reasonable endeavours to deliver the products to the delivery address specified by the customer on the registration from within a reasonable time.
8.4 Delays to delivery. Leith Pub Co Ltd shall not be liable for any failure to deliver within a reasonable time whether the delay is due to causes beyond the control of Leith Pub Co Ltd or otherwise.
8.5 Delivery deemed to have taken place. Delivery will be deemed to be effected upon the direct transfer of possession of the products from Leith Pub Co Ltd to the customer or upon possession of the product being given to a carrier, courier or other bailee purposes of transmission to the customer.

9. Variation/cancellation of order

9.1 The customer may vary or cancel the order up to the point in time that Leith Pub Co Ltd has commenced packing the order by contacting Leith Pub Co on 021 2105577.
9.2 Subject to the customers consent, Leith Pub Co Ltd may substitute a product for a similar product if the initial product ordered by the customer is unavailable.

10. Products

10.1 Risk in the product shall pass to the customer upon delivery. Ownership of any product passes to the customer when the customer has paid for the product in full and delivery is made.

11.Returns of products

11.1 Returns for credit/refund will be given at our discretion.
11.2 To begin a return process please contact orders@saltedcaramelwhisky.co.nz within 7 days of receipt of product.
11.3 If the return process is deemed successful the Product must be in original unhindered packaging.
11.4 Proof of Purchase order or receipt will be required.
11.5 The cost of return is your responsibility

12. Force Majeure

12.1 If the performance by Leith Pub Co Ltd of its obligations under Leith Pub Co Ltd is prevented by reason of ‘force majeure’ (which shall include fire, casualty, accident act of God, natural disaster, any law order, proclamation, regulation, demand or requirement of any government agency strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit electricity or communications failures, or other causes whatsoever beyond reasonable control of Leith Pub Co Ltd) Leith Pub Co Ltd shall be excused from the performance of its obligations under these Terms and Conditions.
